Terms of Service

Welcome to Talia. By creating an account or using the Talia mobile app, web app, or any related services (collectively, the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

The Service is operated by Shangyu Chen, an individual sole trader based in Victoria, Australia (ABN 78 526 386 160). Throughout these Terms, "Talia" refers to Shangyu Chen as the legal operator of the Service. Contact: [email protected].

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you must have a parent or guardian's permission. The Service is not designed for children under 13 and we do not knowingly accept their accounts.

2. Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You may not impersonate another person or create multiple accounts to evade enforcement.
• You may delete your account at any time from within the app.

3. User-generated content (UGC)

Talia lets you submit comments, branch contributions, direct messages, and AI-generated outputs ("User Content"). You retain ownership of your User Content, but you grant Talia a non-exclusive, royalty-free, worldwide license to host, display, distribute, and modify your User Content as necessary to operate the Service. This license ends when you delete the User Content, except where required for legal compliance or backup purposes.

You represent that you have the rights to all User Content you submit and that it does not infringe any third-party rights. See the Community Guidelines for prohibited content.

4. AI-generated content disclaimer

The "AI Replace" feature and any other AI generation tools produce outputs from third-party AI models. We make no warranty that AI outputs will be accurate, appropriate, or fit for any particular purpose. You are responsible for reviewing AI outputs before sharing or publishing them, and for ensuring they comply with applicable law and our Community Guidelines.

You may not use AI generation tools to:

• Create deepfakes or impersonations of real people without their consent
• Create sexual content involving minors (zero tolerance — accounts are immediately removed and reported to law enforcement)
• Create content that violates the Community Guidelines

5. Tacoin (virtual currency)

• Tacoin is a virtual in-app currency used to unlock paid story branches, AI generation, and other features.
• Tacoin has no real-world monetary value and is non-refundable except where required by law (e.g., consumer protection statutes in your jurisdiction).
• Tacoin balances are tied to your account and cannot be transferred or sold to third parties.
• If your account is terminated for violation of these Terms, your Tacoin balance is forfeit.
• iOS in-app purchases are processed by Apple and subject to Apple's terms.

6. Acceptable use

You agree not to:

• Violate any law or third-party right
• Upload malicious code or interfere with the Service
• Reverse-engineer, scrape, or extract data from the Service except via documented public APIs
• Harass, threaten, or impersonate other users
• Post spam or commercial solicitations

7. Termination

We may suspend or terminate your account at any time for violation of these Terms or the Community Guidelines. You may terminate your account at any time. Upon termination, sections 4 (AI disclaimer), 8 (IP), 9 (Liability), 10 (Disputes), and 11 (Governing law) survive.

8. Intellectual property

The Service, including its software, design, and original content, is owned by Talia and protected by copyright and other laws. The Talia name and logo are trademarks. You may not use them without our written permission.

9. Disclaimers and liability

The Service is provided "as is" without warranty of any kind, express or implied. To the maximum extent permitted by law, Talia is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of your use of the Service.

10. Disputes

Any dispute arising out of these Terms will first be addressed by good-faith negotiation between you and Shangyu Chen. If unresolved within 30 days, disputes will be resolved in the courts of Victoria, Australia, except where the Australian Consumer Law or any other non-excludable consumer protection statute provides for an alternate forum (e.g., the Victorian Civil and Administrative Tribunal for small claims).

11. Governing law

These Terms are governed by the laws of the State of Victoria, Australia, and the Commonwealth of Australia where applicable, without regard to conflict-of-laws principles. Nothing in these Terms excludes, restricts, or modifies any right you have under the Australian Consumer Law that cannot be excluded.

12. Changes

We may update these Terms. Material changes will be announced in-app, and the "Last updated" date will reflect the change. Continued use after changes take effect constitutes acceptance.
